Inheritance proceedings

If someone dies, the assets are being inherited by the successors. The succession process depends whether the testator has a testament or not. In case there is a testament the succession plan is determined in the document. If there is no testament, the succession shall be executed based on the stipulations of the law, which often leads to legal disputes between the successors. The inheritance proceedings is an out-of- court procedure performed by the notary that ends by transmitting the assets of the testator to the successors. In case the successors would like to contest the decision of the notary, the proceedings continue before the competent court. In order to avoid future conflicts between the successors it is highly recommended to draw up a testament in time.
